Terms of Service

These Terms of Service ("Terms") govern your access to and use of the EchoLeads website and AI voice sales platform (the "Services"), operated by Rudravega AI Labs Private Limited ("EchoLeads"). By accessing or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. In that case, "you" and "your" refer to the organization.

1. Eligibility & Account

• You must be at least 18 years old and capable of entering into a binding contract.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to provide accurate, current, and complete information when creating or updating your account.

2. Use of the Services

You agree to use the Services only for lawful business purposes and not to:

• Violate any applicable law, regulation, or industry guideline.
• Harass, abuse, or harm individuals through unwanted or deceptive calls.
• Infringe the rights of others, including privacy, publicity, or intellectual property rights.
• Attempt to interfere with or disrupt the integrity, security, or performance of the Services.
• Reverse engineer, decompile, or attempt to derive source code or underlying models except as permitted by law.

You are solely responsible for ensuring that your use of EchoLeads (including automated calling, recording, and messaging) complies with applicable telemarketing, privacy, and data-protection laws in the jurisdictions where you operate.

3. Customer Data

"Customer Data" means any data, content, or information you or your users upload to or process through the Services, including lead lists, contact information, call recordings, and transcripts.

• You retain all rights, title, and interest in and to your Customer Data.
• You grant EchoLeads a limited license to process Customer Data solely to provide, maintain, secure, and improve the Services.
• You represent and warrant that you have all necessary rights, consents, and authorizations to submit Customer Data and to use the Services with respect to that data.

4. Intellectual Property

EchoLeads and its licensors own all rights, title, and interest in and to the Services, including all software, models, interfaces, designs, and documentation, except for Customer Data and third-party components.

No rights or licenses are granted to you except as expressly set out in these Terms or in a separate written agreement. You may not use EchoLeads' trademarks, logos, or brand elements without our prior written consent.

5. Fees & Payment

If you subscribe to a paid plan, you agree to pay all applicable fees in accordance with the pricing and billing terms presented to you. Unless otherwise stated:

• Fees are quoted and payable in the currency specified at checkout or in your order.
• Payments are non-refundable except as required by law or explicitly stated.
• We may suspend or terminate access for non-payment or chargeback.

Additional terms relating to billing and refunds may be published on the EchoLeads website or in an applicable order form or Master Services Agreement.

6. Trials & Beta Features

From time to time, we may offer free trials, pilot programs, or access to beta features. Such offerings are provided "as is" without warranty of any kind and may be modified, limited, or discontinued at any time.

7. Warranties & Disclaimers

To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis. EchoLeads disclaims all warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Services will be uninterrupted, error-free, or meet your specific performance requirements, nor that AI-generated outputs will be accurate or complete in all situations.

8. Limitation of Liability

To the maximum extent permitted by law, in no event will EchoLeads be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Services.

Our total aggregate liability for any claims arising out of or relating to the Services or these Terms will not exceed the amounts paid by you to EchoLeads for the Services in the twelve (12) months preceding the event giving rise to the claim, or, if you are using the Services on a free basis, one hundred U.S. dollars (USD $100).

9. Term, Suspension & Termination

• These Terms remain in effect while you access or use the Services, unless terminated as described here.
• We may suspend or terminate your access if you materially breach these Terms, misuse the Services, or fail to pay fees when due.
• You may terminate your subscription in accordance with the cancellation terms in your order form or account settings.

Upon termination, your right to access the Services will cease, but sections of these Terms that by their nature should survive (including ownership, confidentiality, disclaimers, limitations of liability, and governing law) will continue in effect.

10. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through the Services or via email. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
